Terms and Conditions for Photography and Videography Services

These Terms and Conditions ("Agreement") govern the provision of photography and/or videography services ("Services") provided by Nspeyer, hereafter referred to as "Vendor," to the client ("Client"). By booking our services, you agree to be bound by these terms. The vendor reserves the right to update these terms at any moment without notice.

1. Booking & Payment

• A non-refundable deposit of 50% is required to secure the date and time of the event.

• Full payment must be received at the time of delivery of the gallery.

• Accepted payment methods: Venmo, CashApp PayPal.

2. Cancellation & Rescheduling

• Cancellations made 15 days or more before the event can be rescheduled for another date, excluding weddings.

• Cancellations made within 4 days of the event are non-refundable instead, your payment will be credited for another session.

• Rescheduling is subject to availability and may incur additional fees for weddings.

3. Client Responsibilities

• The Client shall ensure the cooperation of all participants for photo/video coverage and provide necessary access to venues.

• It is the Client’s responsibility to obtain any necessary permissions, permits, or approvals for filming locations.

4. Copyright & Usage

• All images and videos remain the property of the Vendor.

• The Vendor grants the Client a non-exclusive, non-transferable license for personal use unless otherwise specified in writing.

• The Vendor reserves the right to use images and footage for portfolio, website, social media, advertising, and promotional use. The client acknowledges that no compensation will be provided for any and all advertisements.

5. Delivery

• Edited images and/or video will be delivered within 4 weeks after the event.

• Delivery method: [e.g., digital download, USB, online gallery].

• The Vendor retains the right to select the final images/videos delivered.

6. Artistic Style & Editing

• The Client acknowledges that they are familiar with the Vendor's style and portfolio.

• The Vendor will make creative decisions regarding image selection, editing, and retouching. No unedited/raw files will be provided unless agreed upon.

7. Limitation of Liability

• In the unlikely event of equipment failure, loss of data, or other unforeseen circumstances, liability is limited to the return of all payments received.

• The Vendor is not liable for damages or delays caused by weather, acts of God, or other factors beyond their control.

8. Model Release

• The Client grants permission to use the likenesses of themselves and individuals in the images/videos for promotional purposes, including but not limited to Social Media, Print, TV, etc. This model release shall remain indefinitely. The Vendor may grant certain requests at their sole discretion.

9. Indemnification

• The Client agrees to indemnify and hold harmless the Vendor from any claims, damages, or liability arising from the use of the images/video.

10. Governing Law

• These Terms shall be governed by and construed in accordance with the laws of Arizona.
